VACATIOn Rentals – MONT-BLANC IMMOBILIER

These general and special conditions of sale take precedence over all other previous conditions or over any general conditions of purchase.

The validation by the customer of his order, all sales channel combined, implies acceptance, on the one hand, of these general and specific conditions, fully and without reservation, and, on the other hand, of the description of the leased premises and the '' all the services made available (against payment) for the chosen destination, the customer being assumed to have read them on the website or by any other means made available to him.

We draw your attention to the fact that the photos presented on our brochures or our website are in no way contractual and cannot oblige us or engage our responsibility. They should be considered as mere illustrations.

 

  •  Conclusion of the contract

Reservations can be made in writing, by phone, by email with the agencies concerned, by internet via the agencies' website or with partners. The electronic notice of receipt sent by the agencies is not a confirmation of acceptance of the reservation. The travel contract is concluded upon receipt of payment. The customer will be informed of the receipt of payment and the validation of the contract either by email or by post within a maximum period of approximately 7 days.

Each contract is concluded as tourist accommodation. Customers cannot use the rentals as primary or secondary accommodation. They must not engage in any commercial, craft or professional activity. Use of the premises is limited to seasonal rentals, the right to sublet is strictly prohibited.

The consumer's right of withdrawal, in accordance with the provisions of article L 221-28 of the Consumer Code, is not applicable for "the provision of accommodation, transport, catering and leisure services which must be provided on a date or at a specified frequency ”. Thus, the right of withdrawal does not apply to rental contracts concluded with Mont-Blanc Immobilier.

 

 

  • Price

Mont-Blanc Immobilier reserves the right to modify the price at any time. Stays are all billed at the rates in effect at the time of booking the reservation. All orders, whatever their origin, are payable in euros. Prices are per accommodation and per week, unless otherwise indicated. They do not include the tourist tax, additional services or the security deposit that the customer must pay on arrival. Our product offers are valid as long as they are visible on the site mentioned in the event of an internet reservation, or when requesting telephone information in the event of a reservation with the reception teams or with the people in the agency.

 

  • Payment

Mont-Blanc Immobilier offers various methods of payment, in particular: bank card (credit card, MasterCard, visa), checks, ANCV checks, cash. When booking, the customer agrees to pay part or all of the amount of the stay depending on the dates of arrival.

The deposit amount is 25% of the rental price, and must be paid to definitively reserve the rental property. The remainder of the price must be paid at least 30 days before the contract takes effect. For reservations made in the month before the start of the contract, the full price of the reservation must be paid.

The customer must have paid the full balance of his rental by the due date. Mont-Blanc Immobilier will send the client due notices to remind him of them.

All rental documents will be sent to you by post or email in due course, when the full amount has been paid.

In the event of a balance not paid within the time limit, the agencies reserve the right to consider the reservation as void and to cancel it.

 

 

Payment security

Thanks to our secure PAYBOX server, we guarantee complete reliability of all your transactions. For this, we use the most powerful encryption system on the market: SSL (Secure Socket Layer). This encryption system is the most widely used on the Internet to protect the transmission of information between a client and a server. It allows the transfer of your bank details online in complete security. In addition, it is compatible with the latest versions of all browsers on the market. When entering your confidential data you will be shown the following pictograms:. This is proof that the site is secure and that you can enter your card number with confidence. The SSL protocol encrypts all your bank details when they are entered. During their single transfer via the Internet, it is impossible to read them. We never have access to your bank details.


Additional charges

The fixed costs which must imperatively be paid are included in the price of the trip. The variable costs which depend on the number of people, on the composition of the group of people are collected by the competent people.

The handling fees, of an appropriate amount, are a flat rate for all reservations regardless of the method of payment. These administration fees must be paid at the time of booking and are collected in addition to the rental prices. These fees may however vary or even disappear on the sites of our partners.

Tourist taxes are not included in the rental price. Their amounts calculated per person (adults, these taxes do not apply to children under 18) and per night, are set by the Municipal Councils. These entrust our agencies with collecting them from customers and paying them back. These taxes are therefore payable by customers on their arrival.

At the time of handing over the keys, the lessor or the key holder may require the payment of a deposit of an appropriate amount. This payment can be made by check, cash or credit card. In the event that the customer arrives outside reception opening hours, he must send his deposit to reception before the day of his arrival and have paid for his stay in order to be able to collect the keys to his rental.
The deposit will be returned to the client within two weeks of their departure, after the agency has checked the apartment. The return of the deposit does not exclude a possible action for compensation for any deterioration noted. The deposit may be kept in full and returned only in part in the event of a possible action for compensation for any deterioration noted, less the value of damaged items and bank charges caused by payment by check or in foreign currency.

 

 

  • Rental

The tenant will make arrangements to arrive at the agency or reception during opening hours (see below). Failing that, if he wishes to take possession of the keys outside of opening hours, he must pay the balance and the deposit by mail before his arrival. The agency will then tell him where the keys will be left.

The tenant is obliged to comply with the internal regulations in which his rental is located.

The agency reserves the right to show the premises in the event of the sale or rental of accommodation, when requested to do so.

 

Housing

The descriptions indicate whether the accommodation is equipped with bed linen and towels, whether to bring them or whether it is mandatory to rent on site. The standard width of French beds is 1.40 m. If it is possible to rent bed linen and / or towels on site, and if the customer wishes to use this service, he must indicate this when booking, or before arrival. Always bring your own pool or beach towels. As a rule, you should also bring toilet paper, washing-up liquid and cleaning products.

The number of occupants of the rental may not exceed the limit of the number of existing bed places as defined on the description which the tenant acknowledges having read.

The descriptions indicate whether beds and chairs for additional children are available. If this equipment is not included and provided in the rental, the customer can request the rental of this type of equipment from the agency. It is the customer's responsibility to check whether the provision is within the limits of the accommodation. These equipment should be reserved when booking or at least before arrival because the stocks of the agencies are limited.

The customer must check whether the accommodation accepts pets (in principle dogs or cats). In all cases, the pet must be declared when booking, indicating what type of animal it is. For certain accommodations, the reception of animals may be subject to an additional cost, the amount of which will be given at the customer's request.

The agency declines all responsibility in the event of theft or burglary in the rented premises. The owner declares that the building or part of the building belonging to him is insured for the risks which concern him, but the tenant must insure himself for the risks depending on his rental liability or covering his personal property.


Equipment

The accommodations are equipped with crockery and cutlery, generally complete and in sufficient number for the number of people registered. Technical household appliances, such as oven, microwave, coffee maker, dishwasher are available if the description expressly mentions them.

The TV mentioned in the description of the property refers to a color television. In the presence of satellite or cable reception, the text is marked satellite or cable. However, it is not guaranteed that programs can be received in all languages.

Internet and WIFI are available if expressly mentioned in the description. Mont-Blanc Immobilier is not responsible for the permanent availability or the speed and compatibility of WIFI or the Internet. Internet and WIFI are not suitable for commercial use. The customer uses WIFI / Internet at his own risk. The law in force applies to their use. The customer is therefore obliged not to download data containing material (eg films, music tracks) protected by copyright and illegally distributed on stock exchanges on the Internet. In the event of culpable violation of the client's obligations, the latter guarantees us against any action by third parties.

As a tenant, the customer can use all of the rented property, including furniture and everyday items. He undertakes to treat the rented object, its inventory and any common equipment with the greatest care. He is required to repair any damage caused by his fault, the fault of the people accompanying him or of his guests during the rental period. Damages can be charged to the deposit.

 

Inventory

The tenant must, in his interest, check on his arrival in the accommodation the inventory of fixtures as well as the proper functioning of household and sanitary appliances. If there is a complaint, this must be notified to the agency in writing within 72 hours of arrival. After this period, it can no longer be taken into account. For complaints concerning cleaning, the complaint must be immediate, with supporting photos.

Due to the very large number of arrivals and departures at the same time, the agency may not be able to verify the rented premises in the presence of the tenant. An inventory having been made on the departure of the previous tenant, the agency will check the premises on the arrival of the next occupant or within 48 hours after his departure.


Cleanliness

The entrusted apartments must be maintained and left in a good state of cleanliness. Cleaning is the responsibility of the customer. This corresponds to cleaning the kitchen, washing and storing dishes, removing remaining food, as well as any waste, removing sheets, sweeping / vacuuming in all rooms. , so that the rented object can be returned clean.

In some buildings there is a garbage chute on each level. Otherwise, the garbage must be deposited in the premises in the basement or in the external containers preferably.


Car park

The rental description specifies whether a parking space is included in the rental and specifies its type. The tenant will occupy the exact parking space or box whose number is indicated on the description of the apartment. If no parking space is provided, the customer should park in the authorized public parking spaces located in the locality.


Ski

In most rentals a ski room is available where you can leave your ski equipment.
In general, it is forbidden to circulate in the buildings and common areas with ski boots and it is forbidden to leave ski equipment in the corridors and common areas.
As soon as a room and / or a ski locker is provided with the rental, the customer has the obligation to leave his equipment there.

The agency accepts no responsibility for the theft or damage to any ski equipment, wherever it is stored and stored.


Interventions

The interruptions of operation in the General Services of the building such as: heating, hot or cold water, electricity, etc… and the same for the public services such as: water pipe, electricity, telephone, access, etc… Do not not justify a reduction in rent if they are not due to an act of will of the lessor. The agency declines all responsibility for any deprivation or reduction of enjoyment. It is the same for all TV-HIFI devices, household appliances, roller shutters and blinds.
Due to the difficulties experienced during the season in obtaining the intervention of staff or a specialist company, the agency declines all responsibility for the delay in carrying out the necessary repairs. The tenants of chalets must ensure snow removal during their stay.

 

  • Cancellation

It is agreed in the event of cancellation:

    Due to the tenant (except subscription made to the cancellation guarantee and on compliant proof):
    - more than one month before the contract takes effect, the tenant loses the deposit paid,
    - less than one month before the contract takes effect, the tenant loses the balance of the rental
    Due to the agency: Mont-Blanc Immobilier may cancel the contract before the start of the trip, if performance of the contract is impossible due to unavoidable exceptional circumstances. In this case, Mont-Blanc Immobilier loses the right to payment of the price of the trip and will reimburse the tenant for the sums paid.

Any cancellation must be notified in writing and in the best case by registered letter.


Cancellation guarantee

The cancellation guarantee, the applications of which are mentioned below, is offered to you by Mont-Blanc Immobilier.
The amount of the guarantee corresponds to 3% of the total amount of the stay on the accommodation part with a minimum premium of € 12 including tax. This guarantee must be taken out at the same time as the contract. Once it has been established, it cannot be canceled. Payment of the premium is included in the amount of the deposit to be paid on booking.

The guarantee is granted to:

  -  Anyone reserving a stay who has subscribed to the cancellation guarantee when booking as well as the participants mentioned on the registration form.

Guarantee: the contract guarantees the reimbursement of 100% of the sums paid for the rental deposit, less the amount of the guarantee, the administration fees and a lump sum cancellation amount of € 35. Only under the conditions of sale stipulated in the reservation contract provided that the cancellation is the consequence of one of the following generating events:

   - Serious illness, serious accident or death of the insured, of his spouse or of his direct ascendants or descendants, or of any person mentioned in the contract.

* Serious illness and serious accident are understood to mean any deterioration in health noted by a well-known competent medical authority, or any bodily injury preventing the tenant from leaving his home or the hospital where the insured is being treated on the date of the start of the rental period and involving the cessation of any professional or other activity, or incompatible with the nature of the trip and justified by a medical certificate.

  -  Claim causing significant damage to the insured's home or to the business belonging to the insured, occurring before his departure and imperatively requiring his presence at the location of the claim on the day of departure, and justified by a declaration of insurance.
  -  Inability to complete the stay, either as a result of sudden and unforeseen dismissal, or as a result of transfer, implying a definitive change of residence of the person reserving, provided that the employer's notification is subsequent to the effective date of the guarantees.

The warranty is applicable until D-3. Less than 3 days before the start of the stay, the amount of the deposit and the balance paid cannot be refunded.


Exclusions: the following claims are excluded from the cancellation cover:

   - Civil or foreign wars,
   - Disasters and natural disasters for which the events which would motivate them would be prior to the subscription of these guarantees,
   - The weather and snow conditions of the ski area,
   - Interruption of the stay by the tenant or not,
   - A condition or situation prior to the reservation such as: a pre-existing medical condition or infirmity and their progressive complication, pregnancy beyond the 3rd month, childbirth,

Formalities in the event of a claim: except in cases of force majeure, the insured must notify the service provider of the event giving rise to the claim and give notice of the claim in writing with acknowledgment of receipt at the latest within 5 days of the claim, to VMB, with all the supporting documents requested and the original of the contract.

 

Mediation

To settle your disputes, first of all, you must send us a written complaint, by email to the address info(@)mb-immo.com or at the address of your local branch (appearing at the top of your documents), or by mail to the head office 29 Avenue de Miage 74170 Saint-gervais or to the local branch whose address appears at the header of your documents.

It is specified that the tenant's contact details may be used by Mont-Blanc Immobilier for commercial purposes. These will in no case be communicated to anyone.


ELECTIONS OF DOMICILE: the parties elect domicile at the MONT BLANC IMMOBILIER agency, 29 avenue de Miage, 74170 SAINT-GERVAIS LES BAINS; in the event of a dispute, the court of Bonneville (Haute-Savoie) is recognized as having sole jurisdiction.
